Welcome to OwlyArc.
These Terms & Conditions (“Terms”) govern your access to and use of owlyarc.com, including registrations, workshops, webinars, courses, training programs, learning resources, digital content, and other services offered through or in connection with OwlyArc.
By accessing our website, registering for a program, making a payment, or using our services, you agree to these Terms together with our Privacy Policy, Refund & Cancellation Policy, and any additional conditions specifically communicated for a particular program.
If you do not agree with these Terms, you should not purchase or use the relevant services.
1. About OwlyArc Services
OwlyArc provides educational and learning experiences that may include:
- Live online workshops
- Webinars and seminars
- Training programs
- Courses and learning sessions
- Recorded educational content, where offered
- Learning materials and digital resources
- Mentor- or instructor-led educational activities
- Other related learning services
The specific format, duration, curriculum, instructor, eligibility, deliverables, recording availability, certificate conditions, and other program-specific information will ordinarily be described on the relevant registration or program page.
2. Acceptance of These Terms
By using OwlyArc services, you confirm that you have read and understood these Terms and agree to comply with them.
Where you register or purchase a service on behalf of an institution, organisation, employer, or another person, you represent that you have the authority to provide the necessary registration information and, where applicable, accept the relevant terms on their behalf.
3. Eligibility
You must be legally capable of entering into the relevant transaction or agreement under applicable law.
If you are below the age at which you may independently enter into such an agreement, participation or purchase should be undertaken with the involvement and consent of a parent or lawful guardian, where permitted.
Certain programs may have additional academic, professional, age-related, or other eligibility requirements. Where such requirements apply, they will be stated separately.
4. Registration Information
When registering for an OwlyArc program, you agree to provide information that is accurate and reasonably complete.
You are responsible for ensuring that the email address, mobile number, name, and other information submitted during registration are correct. OwlyArc is not responsible for missed communications caused by incorrect contact information supplied by a participant.
We may contact you where clarification is required to complete a registration or provide the purchased service.
5. User Accounts
Certain OwlyArc services may require a user account or authenticated access.
Where an account is provided, you are responsible for:
- Keeping your login credentials confidential
- Not sharing restricted account access with unauthorised persons
- Using your account only for legitimate purposes
- Informing us if you reasonably suspect unauthorised access
OwlyArc may take reasonable steps to secure or temporarily restrict an account where suspicious or unauthorised activity is detected.
6. Program Registration and Confirmation
Submission of a registration form alone does not necessarily constitute confirmation of participation.
For paid programs, registration is ordinarily confirmed after successful payment and completion of any required registration process.
Where participation is subject to limited capacity, eligibility review, or another stated condition, confirmation may additionally depend on fulfilment of that condition.
7. Pricing and Payments
Prices displayed on OwlyArc program pages are the prices applicable at the time of purchase, subject to any clearly stated taxes, discounts, promotional conditions, or other charges.
OwlyArc may change the price of future programs or services. A subsequent price change does not ordinarily alter a transaction that has already been successfully completed.
Payments may be processed through authorised third-party payment service providers, including Razorpay.
You agree to provide accurate information required to process the transaction and not to use a payment method without appropriate authorisation.
A transaction may be subject to verification by the relevant payment provider, bank, UPI provider, card network, or other financial institution.
8. Failed, Pending or Duplicate Transactions
A payment attempt may occasionally remain pending, fail, or be reversed due to circumstances involving banks, payment gateways, networks, or technical systems.
If payment has been deducted but registration has not been confirmed, you should contact us with sufficient transaction information so that the payment can be reconciled.
Verified duplicate payments will be handled in accordance with our Refund & Cancellation Policy.
9. Refunds, Cancellations and Rescheduling
Cancellation, rescheduling, participant withdrawal, duplicate payment, and refund matters are governed by our Refund & Cancellation Policy.
Participants are encouraged to review that policy before completing a purchase.
Nothing in these Terms is intended to exclude rights that cannot lawfully be excluded under applicable consumer-protection law.
10. Program Schedules and Changes
We make reasonable efforts to conduct programs according to the schedule, format, instructor information, and description published at the time of registration.
However, circumstances may occasionally require reasonable changes to:
- Session timing
- Session sequence
- Instructor or mentor
- Delivery platform
- Teaching arrangement
- Learning resources
- Other operational aspects of a program
Where a change materially affects a registered participant, we will endeavour to communicate it within a reasonable time.
Material cancellations or rescheduling will be handled in accordance with our Refund & Cancellation Policy.
11. Online Sessions
Online sessions may be delivered through third-party video-conferencing or learning platforms.
Participants are responsible for having a reasonably suitable device, internet connection, and any software necessary to access the session.
Joining links, passwords, meeting credentials, or restricted program access provided to a participant are intended for that participant and must not be publicly distributed or shared without permission.
12. Participant Conduct
Participants are expected to interact respectfully and professionally during OwlyArc programs.
Participants must not:
- Harass, threaten, abuse, or deliberately disrupt another participant or instructor
- Share unlawful, discriminatory, defamatory, obscene, or harmful material
- Disrupt a live session or interfere with its delivery
- Attempt to gain unauthorised access to another user’s account or restricted resource
- Impersonate another person
- Use program access for fraudulent or unlawful purposes
- Distribute malicious software, harmful code, spam, or phishing material
We may take proportionate action, including removing a participant from a session or restricting access, where conduct materially interferes with the safety, integrity, or proper functioning of a program.
13. Intellectual Property
Unless otherwise stated, educational content provided by OwlyArc, including presentations, recordings, videos, graphics, course materials, templates, documents, exercises, website content, branding, and other original materials, may be protected by intellectual-property law.
Registration for a program gives you a limited, personal, non-transferable right to access the materials made available to you for your own learning or other expressly permitted use.
Unless specifically authorised, you must not:
- Reproduce substantial parts of restricted learning materials
- Sell, sublicense, republish, or commercially distribute program materials
- Upload paid or restricted materials to public websites or repositories
- Share restricted recordings or access credentials with unauthorised persons
- Remove copyright, attribution, or ownership notices
- Record or redistribute a session where recording or redistribution has not been authorised
Nothing in this section is intended to restrict uses permitted by applicable law.
14. Session Recordings
Some OwlyArc sessions may be recorded for educational purposes, participant replay access, quality review, or development of learning resources.
Where a session is recorded, participants will be appropriately informed. Personal information appearing in recordings will be handled in accordance with our Privacy Policy.
Participants may not independently record, reproduce, livestream, publish, or distribute a session without prior permission where such permission is required.
15. Certificates
Certain programs may provide certificates of participation, attendance, or completion.
Where a certificate is subject to attendance, completion, assessment, participation, or another requirement, the relevant conditions may be communicated separately.
Unless expressly stated otherwise, an OwlyArc certificate should not be interpreted as a university degree, statutory qualification, professional licence, accreditation, or regulatory certification.
16. Educational Nature of Services
OwlyArc services are provided primarily for educational and learning purposes.
Participation in a workshop, course, webinar, or training program does not guarantee:
- Employment or promotion
- Academic admission
- Publication of research or other work
- Professional registration or licensing
- Examination results
- Business or financial outcomes
- Any particular academic or professional result
Individual outcomes depend on many factors outside OwlyArc’s control, including the participant’s effort, circumstances, prior knowledge, institutional requirements, and decisions made by third parties.
17. Professional and Specialist Information
Educational programs may discuss research, technology, law, management, science, finance, health, academic practice, or other specialist subjects.
Unless expressly identified otherwise, educational discussion should not be treated as personalised legal, medical, financial, regulatory, or other professional advice.
Participants remain responsible for obtaining appropriate professional advice where their individual circumstances require it.
18. Third-Party Tools and Platforms
OwlyArc programs or website services may refer to or make use of third-party tools, software, websites, artificial-intelligence services, databases, video-conferencing systems, payment platforms, or other external services.
Such third-party services may be governed by their own terms, privacy policies, licensing conditions, subscription requirements, or usage restrictions.
OwlyArc does not control the continued availability, pricing, features, outputs, or policies of independent third-party services.
References to a third-party product or service for educational purposes do not necessarily constitute endorsement or guarantee of that product or service.
19. Academic Integrity and Responsible Use
Participants are responsible for using knowledge, software, artificial intelligence tools, research resources, and other materials discussed in OwlyArc programs in accordance with applicable laws, institutional policies, academic-integrity requirements, intellectual-property rights, and ethical standards.
OwlyArc does not authorise plagiarism, fabrication, falsification, academic misconduct, copyright infringement, or other unlawful or unethical use of educational material.
20. User-Submitted Content
You may occasionally submit questions, assignments, feedback, comments, files, or other content while participating in OwlyArc services.
You remain responsible for content you submit and should ensure that you have the right to provide it.
You should not submit confidential, proprietary, sensitive, or third-party personal information unless doing so is necessary, authorised, and appropriate for the particular service.
Where technically necessary to provide the service, you grant OwlyArc only the limited permission reasonably required to host, transmit, display, or process the submitted content for that purpose.
21. Testimonials and Promotional Use
Providing feedback about a program does not automatically grant OwlyArc unrestricted permission to use your name, photograph, image, voice, or testimonial in advertising.
Where identifiable participant feedback or likeness is intended to be used for promotional purposes, appropriate permission will be obtained where required.
22. Website Information
We make reasonable efforts to keep information on owlyarc.com accurate and current.
However, website material may occasionally contain typographical errors, outdated information, technical errors, or omissions.
Where an error materially affects a purchase or program registration, we will take reasonable steps to correct the information and address the affected transaction appropriately.
23. Availability of the Website and Services
We aim to maintain reliable access to OwlyArc services but cannot guarantee that every website function, live session, recording, or digital service will operate without interruption.
Temporary interruptions may result from maintenance, internet failures, third-party platform outages, cybersecurity measures, software problems, infrastructure failures, or circumstances outside our reasonable control.
Where an interruption materially affects delivery of a purchased service, OwlyArc will take reasonable steps appropriate to the circumstances.
24. Prohibited Use of the Website
You must not use OwlyArc systems or services to:
- Commit or facilitate unlawful activity
- Infringe intellectual-property or privacy rights
- Introduce malicious code or malware
- Conduct unauthorised security testing or system intrusion
- Scrape or extract protected content in a manner prohibited by law or these Terms
- Circumvent authentication, access restrictions, or security controls
- Send spam, phishing messages, or fraudulent communications
- Interfere with the normal operation of the website or services
25. Privacy and Personal Data
Personal information collected through OwlyArc is handled in accordance with our Privacy Policy.
Our privacy practices take account of applicable Indian data-protection and information-technology requirements, including relevant provisions of the Digital Personal Data Protection framework as they become applicable.
Questions relating specifically to privacy or personal-data rights may be sent to: privacy@owlyarc.com.
26. Suspension or Termination of Access
OwlyArc may suspend or terminate access to a service where reasonably necessary because of:
- Material violation of these Terms
- Fraudulent or unauthorised activity
- Abuse of another participant or instructor
- Unauthorised distribution of restricted content
- Attempts to compromise the security of our systems
- A legal or regulatory requirement
Where appropriate, action will be proportionate to the circumstances. Termination does not affect rights or obligations that arose before the termination.
27. Limitation of Liability
To the extent permitted by applicable law, OwlyArc will not be responsible for indirect or consequential loss arising solely from circumstances outside our reasonable control or from a participant’s misuse of the website, educational material, or third-party services.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
Nothing in these Terms is intended to waive or restrict any statutory consumer right that cannot lawfully be waived or restricted.
28. Events Beyond Reasonable Control
OwlyArc will not be considered in breach of these Terms merely because performance is delayed or prevented by circumstances reasonably beyond its control.
Such circumstances may include:
- Natural disasters
- Severe weather
- Government restrictions
- Public emergencies
- Widespread internet or telecommunications failures
- Major third-party infrastructure outages
- Acts of war, civil disturbance, or similar extraordinary events
Where such circumstances materially affect a scheduled paid program, OwlyArc will endeavour to provide an appropriate alternative, reschedule, or other remedy consistent with our Refund & Cancellation Policy and applicable law.
29. Governing Law
These Terms are governed by the laws applicable in India.
Any dispute or claim relating to these Terms or OwlyArc services will be subject to the jurisdiction and dispute-resolution mechanisms available under applicable Indian law.
Nothing in this section prevents a consumer from exercising rights or remedies available through a competent consumer commission, court, regulator, or other authority where provided by law.
30. Changes to These Terms
We may revise these Terms from time to time to reflect changes in our services, technology, operational practices, or applicable legal requirements.
The current version will be published on this page together with its updated revision date.
Material changes will apply prospectively as appropriate. Where applicable law requires additional notice or consent for a particular change, we will take the necessary steps.
31. Severability
If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions will continue to apply to the extent legally permissible.
32. Entire Agreement
These Terms, together with our Privacy Policy, Refund & Cancellation Policy, and any specific conditions communicated for a particular program, constitute the terms governing the relevant use of OwlyArc services.
If a program page contains a specific condition that clearly applies only to that program, that specific condition will apply to that program to the extent it does not conflict with mandatory law.
